Planning Enquiry

Please use this form if you require an opinion as to whether you need planning permission from the Council (i.e. express planning consent) for a proposed house extension or outbuilding. It is suggested that you read the guidance note 'Planning Permission - A Guide for Householders' before completing this form as this may give you the information you require.

Under the Town and Country Planning Act 1990 (as amended), planning consent is required for most new developments and some changes of use of buildings or land. The information you supply on this form will be used to determine whether you need to apply for planning permission from the Council, will be stored on the Council's database for monitoring purposes and will not be shared with any other parties.

 

Important notes

  • You must ensure that the information you supply is comprehensive and accurate, since the Council's opinion will be based on it. Any omissions or inaccuracy may result in an incorrect opinion as to whether planning permission by the Council is required, for which the Council cannot subsequently be held responsible.
  • Any opinion given by the Council cannot be taken or relied upon as a definitive statement that express planning permission is or is not required. To obtain such a definitive statement, an application for a Certificate of Lawfulness must be made under Section 192 of the Town and Country Planning Act 1990, as amended by Section 10 of the Planning and Compensation Act 1991 The Town and Country Planning (Development Management Procedure) (England) Order 2015, for which a fee is payable. A form and full details of this application can be obtained from Development Management, Planning and Economic Development, Directorate of Place, 4 Ednam Road, Dudley, West Midlands DY1 1HL or from the Planning Portal.
